You are eligible for damage coverage if all of the following apply:

Your rental and claim comply with our terms of use.

You and your equipment are located in the Greater New York Metropolitan Area and the rental took place in the Greater New York Metropolitan Area ( New York City, the counties of Nassau, Suffolk, Rockland, and Westchester in New York, and the counties of Bergen, Essex, Hudson, Middlesex,Morris, Passaic, Somerset, and Union in New Jersey)

You gear has been rented out on KitSplit and you reported the damage within 1 hour of the damage/theft event or within 24 hours of receiving the damaged equipment.


My equipment was damaged or stolen, what should I do?

Contact the renter and notify them of your complaint. Often you and the renter can resolve the problem on your own.

File a police report within 48 hours if the equipment is worth more than $300 and one of the following is true:

The renter refuses to take responsibility for the damage

The renter has not returned the equipment and has been unresponsive for 24 hours

The equipment was stolen from the renter during the duration of the rental

Document the damage with photographs or video of the problem

Collect proof of ownership in the form of receipts or legal documents that refer to you as the owner

Estimate the cost of damage

Submit a claim within 24 hours and schedule a time to meet with a KitSplit equipment specialists to review the damage and collect your reimbursement.


What documents do I need to submit with the claim?

A filed police report including report #, name of officer and phone number for all claims over $300

All evidence of damage including photos and videos

Detailed written description of damage or theft and the events surrounding the rental

Proof of ownership in the form of receipts or legal documents that refer to you as the owner

Estimate of the fair market cost of repair

KitSplit Damage and Theft Coverage Policy Summary

How it works:


Gear coverage

Rentals of most Gear with a listed replacement value (“LRV”) of $10,000 or less; provided that in no event shall the LRV exceed the manufacturer’s suggested list price (taking into account any included accessories, upgrades, customizations, or the like).

Occurrence Coverage

Damage, theft, or loss (“Claims”) during the duration of a Rental (excluding normal wear and tear).

KitSplit Damage and Theft Coverage (KDTC)

Subject to verification, KitSplit will reimburse Owner for actual and verified Claims up to the lesser of the LRV or $10,000.

KitSplit Assesment and Verification

KitSplit in its sole discretion will evaluate Claims in order to allocate responsibility and verify value.

Waiver and Release

Owner will provide a waiver and release to KitSplit and Renter in consideration for payment to Owner of Renter Deposit and KitSplit Assurance.

Occurrence Exclusion

Personal injury, job/income loss, business interruption, or damage resulting during delivery, whether or not in the possession of a third party. IN NO EVENT WILL KITSPLIT BE LIABLE FOR, AND NO COVERAGE UNDER THIS POLICY WILL BE AVAILABLEEL FOR, INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL OR INCIDENTAL DAMAGES.

Gear exclusion

Drones, underwater equipment, specialty/one of a kind, lighting bulbs or as otherwise specifically excluded on any Rental Listing.


KitSplit Damage and Theft Coverage Policy: Step-by-Step


1. Request

Renter selects Gear on KitSplit and enters payment method.

2. Acceptance

Owner accepts the rental request.

3. Pickup & Inspection

Renter selects Gear on KitSplit and enters payment method.

4. Claims

Owner delivers Gear to Renter for inspection. By acknowledgment of KitSplit’s Rental Terms and Conditions, Renter accepts terms of Rental agreement and that Renter has received the Gear in good condition.

a. Claims must be reported and appropriately documented to KitSplit promptly upon discovery. Undue delay will disqualify any Claims from the KDTC.

b. Claims for theft of Gear or unresolved damage worth more than $300 must be documented with a police report filed within 48 hours of discovery.

c. Claims reported within one (1) hour following Pickup & Inspection are presumptively the responsibility of the Owner for which no coverage under the KDTC will be available. In such event Renter may return the Gear for a full refund and Owner will forfeit the Rental Payment.

d. Claims reported after one (1) hour following Pickup & Inspection are presumptively the responsibility of the Renter for which the Renter Deposit will be charged.

e. In the event Gear is covered by applicable insurance, such insurance shall be the primary recourse for any Claims.

5. KitSplit Assesment and Verification

In the event of a dispute concerning responsibility for any Claim or the amount thereof, KitSplit will in good faith evaluate available information and attempt to allocate responsibility and proceed accordingly. KitSplit will also evaluate the value of any Claims, including consultation with individuals with expertise in the sale and repair of the relevant Gear; verify the LRV against both manufacturer’s suggested list prices and liquid secondary markets such as eBay; and validate the amount of loss. KitSplit takes fraud very seriously; any suspicion of fraud will be reported to the authorities. KitSplit’s determinations will be final and will be based on the KitSplit Dispute Resolution Terms included in the Terms of Service.

6. Payout

On a determination of Renter’s fault, KitSplit will compensate Owner up to the lesser of the LRV and $10,000. In the event of theft or damage not the fault of the Renter, the Rental Payment will be refunded to the Renter and the Owner will forfeit any portion of the Rental Price it has received.

7. Deductible

On determination of Renter’s fault, KitSplit will require that the renter pays a deductible of up to $500 [KB1] per claim. On the second claim filed the deductible rises to $1000.

8. Owner Waiver, Release and Subrogation of Claims

Eligibility for any payout on the KDTC the will require Owners to deliver a waiver, release and subrogation of claims. In the event of gross negligence, misuse, violation of the terms of the Rental Contract, or fraud, KitSplit may in its sole discretion elect to pursue remedies against the responsible party.

Rentals of Gear with an LRV in excess of $10,000

Third-party insurance is recommended (KitSplit recommends Dennis Reif)

Renters must provide both the owner and KitSplit (via contact@kitsplit.com) proof of insurance that covers Gear for the duration of the rental, with both Owner and KitSplit listed as loss payees

Rentals of Gear with an LRV greater than $10,000 will not be eligible under KitSplit’s Damage & Loss Assurance policy.

Owners who elect to list their Gear without proof of insurance do so at their own risk and KitSplit will not be involved in the dispute resolution.
